Terms of Use

Thank you for visiting the AMOR website located [amorgoldbars.com] (the “Site”)! The Site is the internet property of AMOR (“AMOR”, “we” or “us”). By using and/or accessing AMOR, you are agreeing to comply with and be bound by the following Terms and Conditions (“Agreement”). The Agreement is inclusive of any operating rules, policies, price schedules, and/or other supplemental terms and conditions or documents expressly incorporated herein by reference and/or published from time to time. Please review the terms of this Agreement carefully. AMOR’s terms and conditions were developed to ensure that our customers are using our services with due regard to their rights and the rights of other users, and in conformity with AMOR’s standard and current procedures, rules, regulations, requirements and terms and conditions. Your use of Services is also subject to any additional terms, conditions and policies that we may separately provide to you, and any agreements you have separately executed with AMOR,. If you do not agree to this Agreement in its entirety, you are not authorized to use the Site or our services in any manner or form. 

1. Acceptance of Agreement. You agree to the terms and conditions outlined in the Agreement with respect to the use of the Site and AMOR’s services. The Agreement constitutes the entire agreement between you and AMOR with respect to your use of the Site and services, and supersedes all prior or contemporaneous agreements, representations, warranties, and/or understandings with respect to the Site and services. We may amend the Agreement from time to time in our sole discretion, without specific notice to you. The latest Agreement will be posted on the Site, and you should review the Agreement prior to using the Site or services. By your continued use of the Site and services, you hereby agree to comply with all of the terms and conditions contained within the Agreement effective at that time. Therefore, you should regularly check this page for updates and/or changes.

2. Requirements. This Site and services are available only to individuals who can enter into legally binding contracts under applicable law. This Site and services are not intended for use by individuals under the age of eighteen (18). If you are under the age of eighteen (18), you do not have permission to use and/or access this Site. 

3. Fees: We charge a flat fee over spot price on all bars that we offer as follows:

  • $125 Flat Fee for the 3, 5, and 10 gram bars
  • $150 Flat Fee for the 1 once bar

Plus a one-time processing fee of $10 will apply to subscription purchases only.

4. Locking In the Price: Your locked in price is a binding agreement which cannot be canceled without penalty. If you decide to take advantage of one of our monthly SUBSCRIPTION payment plan, your price will be locked in when you reach the price of the bar plus our premium, and a $10 processes fee. For example (illustration purposes only): If you select a $30 subscription plan for our 3 gram gold bar the price will be locked in at your last payment when the balance if paid in full. For example if at your tenth payment the AMOR gold bar price is $300 (spot plus premium, and processing fee) we will ship you the bar. Due to the market fluctuation, the price of our bar may go up or may go down. Any credit will be applied to your account  towards your next gold bar. 

5. Accepted Payment Method: Credit/Debit Card - accepted for all orders. We accept MasterCard, Visa, American Express and Discover. Funds typically process with 24-48 business hours. Bank Wire - Bank wire is the only method of payment accepted for orders greater than $10,000. Bank wire instructions are emailed to you once you submit an order. Bank wire payments need to be received in order to lock your rate and begin processing your order.

6. Cancellation: If you decide to cancel your order will be subject to restocking/cancellation fee of 10% of the full purchase price. Additional fees may apply. 

7. Return/Refund Policy: All sales are final, we don’t accept returns. 

8. Sales Tax. When you purchase products on amorgoldbars.com, we may have to collect sales tax on some or all of the products you purchase. The amount you pay OR don't pay will be directly related to where you choose to ship the product and what product(s) you decide to purchase. This is important to note since you may be shipping gold or silver to another state you are not living in. In this case, you would be subject to the local sales tax of the state you are shipping metal to. For example, if the state you live in requires us to collect sales tax but the state you store your gold or silver in does not require us to collect sales tax and you shipped your products to your storage depository, then we would not be required to collect sales tax. 

9. Shipping and Processing: During normal market conditions due to the ever rising demand for gold, our shipping queue is 2-3 weeks after your final payment has cleared our account. 

All domestic are insured for free. All orders are shipped fully insured via USPS, UPS, and FedEx at the discretion of AMOR Gold Bars Inc, unless otherwise stated on the website. If anything should happen to your order during shipping, our insurance will cover the package (see below for restrictions which are put in place by our insurer). A signature will be required upon receipt of the package by the consumer at the discretion of AMOR Gold Bars Inc. You might be permitted to file a claim on our insurance policy provided you directly receive the package from the common carrier. If you have agreed to waive signature requirements with your mail carrier, our insurance will not cover your package. If you have other individuals signing for your packages such as property managers, employees, neighbors, etc., or if you have us ship to a UPS Mail Store locations our insurance will not cover your package. If your package is lost or damaged, it will be the responsibility of AMOR Gold Bars Inc to file a claim with our insurance company. Once the claim is filed, you agree to fully cooperate with any requirement which may be required as part of the investigation. Any disputes regarding damaged, missing items must be reported to AMOR Gold Bars Inc within 3 business days of delivery date. Failure to fully cooperate will jeopardize the ability for us to replace or refund your lost or damaged package. Upon claim approval, we will replace or refund your purchase at our sole discretion. 

We currently offer domestic shipment only at a flat rate of $9.90 per item. We do not ship to a P.O. Box.

10. Indemnification. You agree to indemnify and hold AMOR, its service providers, parents, subsidiaries and affiliates, and each of their respective shareholders, officers, directors, employees, agents, co-branders and/or other partners, harmless from and against any and all claims, expenses (including reasonable attorneys’ fees), damages, suits, costs, demands and/or judgments whatsoever, made by any third-party due to or arising out of: (a) your use of the Site and/or AMOR’s Services; (b) your breach of the Agreement; and/or (c) your violation of any rights of another individual and/or entity. The provisions of this paragraph are for the benefit of AMOR, its service providers, parents, subsidiaries, and/or affiliates, and each of their respective shareholders, officers, directors, members, employees, agents, licensors, suppliers and/or attorneys. Each of these individuals and entities shall have the right to assert and enforce these provisions directly against you on its own behalf. 

11. Disclaimer of Warranties.  No waiver under this Agreement will be valid or binding unless set forth in writing and duly executed by the Party against whom enforcement of such waiver is sought. Any such waiver will constitute a waiver only with respect to the specific matter described therein and will in no way impair the rights of the Party granting such waiver in any other respect or at any other time. Any delay or forbearance by either Party in exercising any right hereunder will not be deemed a waiver of that right.

12. Limitation of Liability. EXCEPT IN CONNECTION WITH CUSTOMER’S VIOLATION OF ANY OF THE TERMS SET FORTH IN THIS AGREEMENT, IN NO EVENT WILL EITHER PARTY BE LIABLE TO THE OTHER PARTY FOR ANY INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, REGARDLESS OF THE NATURE OF THE CLAIM, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, COSTS OF DELAY, ANY FAILURE OF DELIVERY, BUSINESS INTERRUPTION, COSTS OF LOST OR DAMAGED DATA OR DOCUMENTATION, OR LIABILITIES TO THIRD PARTIES ARISING FROM ANY SOURCE, EVEN IF A PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION UPON DAMAGES AND CLAIMS IS INTENDED TO APPLY WITHOUT REGARD TO WHETHER OTHER PROVISIONS OF THIS AGREEMENT HAVE BEEN BREACHED OR HAVE PROVEN INEFFECTIVE. THE CUMULATIVE LIABILITY OF MY TOWN  TO CUSTOMER FOR ALL CLAIMS ARISING FROM OR RELATING TO THIS AGREEMENT, INCLUDING, WITHOUT LIMITATION, ANY CLAIM FOR INDEMNIFICATION OR ANY CAUSE OF ACTION SOUNDING IN CONTRACT, TORT, OR STRICT LIABILITY, WILL NOT EXCEED THE TOTAL AMOUNT OF ALL FEES PAID OR TO BE PAID TO AMOR  BY CUSTOMER DURING THE TWELVE (12)-MONTH PERIOD PRIOR TO THE ACT, OMISSION OR OCCURRENCE GIVING RISE TO SUCH LIABILITY. THIS LIMITATION OF LIABILITY IS INTENDED TO APPLY WITHOUT REGARD TO WHETHER OTHER PROVISIONS OF THIS AGREEMENT HAVE BEEN BREACHED OR HAVE PROVEN INEFFECTIVE THIS LIMITATION OF LIABILITY IS INTENDED TO APPLY WITHOUT REGARD TO WHETHER OTHER PROVISIONS OF THIS AGREEMENT HAVE BEEN BREACHED OR HAVE PROVEN INEFFECTIVE.

13. Third Party Websites. The Site may provide and/or refer you to links to other Internet websites and/or resources. Because AMOR has no control over such third party websites and/or resources, you hereby acknowledge and agree that AMOR is not responsible for the availability of such third party websites and/or resources. Furthermore, AMOR does not endorse, and is not responsible or liable for, any terms and conditions, privacy policies, content, advertising, services, products and/or other materials at or available from such third party websites or resources, or for any damages and/or losses arising therefrom. 

14. Privacy Policy. Use of the Site, and all comments, feedback, information, data or materials that you submit through or in association with the Site is subject to our Privacy Policy, which is hereby incorporated into and made a part of this Agreement. We reserve the right to use all information regarding your use of the Site, and any and all other personally identifiable information provided by you in accordance with the terms of our Privacy Policy. AMOR has the capability of collecting various bits of information from you without your active participation.  Such information might include: IP address, browser type/version and computer platform. Your browser automatically submits this information in order to correctly fulfill page requests. No other information will be obtained from you without your consent. AMOR safeguards the security of the data you send us. Credit card numbers are also stored in encrypted form. If you use the AMOR Website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Like many websites, AMOR reserves the right to use cookie or tracking technology. 

15. Legal Warning. Any attempt by any individual, whether or not a AMOR customer, to damage, destroy, tamper with, vandalize and/or otherwise interfere with the operation of the Site, is in violation of criminal and civil law and AMOR will diligently pursue any and all remedies against any offending individual or entity to the fullest extent permissible by law and in equity.

16. Miscellaneous. This Agreement shall be treated as though it were executed and performed in New York and shall be governed by and construed in accordance with the laws of the State of New York (without regard to conflict of law principles). 

17. Market and Investment Risk: All investments carry risk. You are responsible for your investment decisions. By purchasing through amorgoldbars.com, we are not responsible for any losses of your investment decisions.
